Marriage breakdown
The breakdown of a marriage is deeply distressing and traumatic, with added worries about income and accommodation. Bitterness and recrimination may be natural responses, but often make matters worse and substantially add to the costs.
We are very conscious of the fact that large sums spent on legal fees only add to the financial hardship that is inevitably suffered when one household splits into two.
At Baehrs we strive wherever possible to take the heat out of the situation rather than add to it. As a member of the Solicitors Family Law Association (now known as Resolution). Eric Baehr naturally subscribes to its code of conduct. However when firm and determined representation is needed, we will provide it.
We have considerable experience in the financial and property disputes that usually arise following the breakdown of a marriage.
Where appropriate, we follow the ancillary relief protocol , which aims to achieve settlement of claims without the need for expensive and risky court proceedings. This can be achieved, for instance, through alternative methods of dispute resolution such as mediation.
In April 2011 the old rules relating to court procedure in family matters was replaced by a brand new set of regulations The Family Procedure Rules. These place a very strong emphasis on mediation. So much so that, before commending court proceedings, parties have to attend a “Mediation Information and Assessment Meeting” to ensure that they understand the importance and benefits of mediation.
